MANILA, Philippines – Iba-iba ang emosyon na na-trigger ng paglabas ng SC (Supreme Courtroom) resolution on the impeachment trial of Vice President Sara Duterte.

Si Senator Bato dela Rosa nga, na kaalyado ng mga Duterte, minention pa ‘yong Holy Spirit sa reaksyon niya doon sa SC ruling. Pero aspect word, ang courtroom choices po ay nakabase sa batas at hindi sa faith.

Pero could ilang officers din na nagpakita ng pagkadismaya dahil doon sa resolution.

Ang tanong na kailangan nating sagutin ngayon ay puwede ba natin i-criticize ang Supreme Courtroom choices? Pahiram ng ilang minuto at i-discuss natin intimately.

By construction, ang Supreme Courtroom ang highest courtroom of the land. At one level pa nga, tinatawag na “gods of Faura” ‘yong mga SC justices. Pero hindi nila gusto ‘yan dahil tao lang naman daw sila at hindi sila infallible or nakakamali lang din naman sila.

Dahil sa energy at affect ng SC ay could notion na dapat ‘yong mga resolution na inilalabas nito ay hindi puwedeng kuwestyunin o labanan. Na dapat ‘yong isang SC resolution ought to be taken as is.

Sorry, pero maling paniniwala po ito.

The truth is, ‘pag could isang SC resolution nga, puwede mo pang i-apela ito sa pamamagitan ng Movement for Reconsideration.

Katulad dito sa impeachment case ni Vice President Sara Duterte, ang Home of Representatives ay i-a-appeal pa nila ‘yong desisyon ng Korte.

Noong pinarusahan ng Korte Suprema ang serial red-tagger na si Lorraine Badoy dahil sa pag-threaten niya sa isang Manila choose, doon sa desisyon na isinulat ni Senior Affiliate Justice Marvic Leonen, sinabi ng SC na ang pag-criticize sa Korte ay bahagi ng constitutional proper to free speech, expression, and of the press.

Ibig sabihin, puwede tayo magpahayag ng ating mga criticisms towards the Supreme Courtroom. Kaya could paalala rin si UP regulation professor Dante Gatmaytan sa mga taong galit na galit sa mga kapwa nila na nag-voice out ng criticisms towards the current SC resolution.

However after all, could limitations ‘yong criticisms na puwede nating ibato sa Korte Suprema para nga naman hindi masyadong um-OA ‘yong mga criticisms.

Doon nga sa kaso ni Badoy, sabi ng SC ay legitimate naman daw kung iki-criticize ang Korte. Pero ‘yong criticisms daw ay hindi dapat makakaabot sa level nate-threaten nito ‘yong judicial independence o ‘yong independence ng mga Korte natin.

Sa isa pa pong kaso, the Macaset case of 2008, sinasabi doon na could vital line na nagse-separate doon sa authentic criticisms towards the Courtroom at ‘yong pag-atake sa Korte at sa mga judges.

Kaya nandiyan din ‘yong contempt powers ng Korte o ‘yong kapangyarihan ng Korte na magpataw ng parusa. Puwede gamitin ang contempt powers para doon sa mga taong aabusuhin ang free speech para i-threaten ang independence ng Korte.
